ART AND ARTIFICIAL INTELLIGENCE: THE PRISM OF COPYRIGHT DILEMMAS

The present scientific article aims to analyze the creation of images generated by Artificial Intelligence through the lens of artistic production. To this end, the research is based on bibliographic sources as well as doctrinal, legal, and jurisprudential content directly and indirectly related to the topic. Currently, there is debate over whether these AI-generated images fit within the concept of art and whether they may be characterized as plagiarism. Therefore, this article will be developed in three parts: Artificial Intelligence, the devaluation of authorial works, and regulation. In addition, this is a contemporary subject, with information that was discussed and decided while the research was still in development, but which was incorporated due to its significant informational relevance, further highlighting the importance and the contemporary nature of the debate, despite the underlying technology being older. The study concludes that these images do not qualify as art and that they may indeed fall within the scope of plagiarism.
